NCC Urges Adoption of COVID Liability Protection

07/27/2020

The National Chicken Council, along with approximately 40 agricultural organizations representing a broad segment of food and livestock production, have urged adoption of H.R.7528, The Get America Back to Work Act of 2020.

The bill introduced into the House of Representatives is intended “to limit the civil liability of persons for the spread or possible transmission of SARS-CoV-2 caused by an act or omission while acting in good faith during the COVID-19 emergency period.”

In the letter supporting the bill, the signatories stated “We believe that it is vitally important for lawmakers to protect businesses that took necessary precautions to mitigate the spread of the coronavirus from unfounded lawsuits.  For that reason we were pleased to see you introduced this bipartisan bill.”

The letter noted “No one is asking lawmakers to protect bad actors, such as businesses that willfully ignored the risk of the spread of COVID-19, committed gross negligence and did not attempt to adhere to the recommended health and safety guidance.”  The letter did, however, emphasize “businesses that made reasonable good faith efforts to comply with government guidance should be shielded from liability.”
