In a unanimous decision, the Ninth Circuit rejected an appeal by the National Pork Producer’s Council and the American Farm Bureau Federation challenging California Proposition #12. Since California Proposition #2 was adopted by ballot in 2008, numerous c
hallenges advanced by animal producers and a consortium of states have been rejected by Federal courts. Unless some relevant and unique legal issue is raised there is little possibility that a further appeal to SCOTUS will have any other outcome that refusal to grant certiorari, letting stand the Ninth Circuit decision.
