Washington State ‘Price Fixing’ Litigation Nets $35 Million

05/02/2023

Following a lawsuit filed by Bob Ferguson the Attorney General of the State of Washington, in October 2021, fourteen of the nineteen plaintiffs have settled with a $35 million payment to the State.

A lawsuit alleged that producers increased the price of chicken to consumers from 2008 onwards through unlawful coordination designed to manipulate production volume through the exchange of information obtained from a benchmark costing system.

Of the nineteen integrators named in the lawsuit, Foster Farms, Sanderson Farms, Wayne Farms, House of Raeford Farms and Claxton Poultry have yet to settle.  The fourteen companies paid between $290,000 to $11 million each but did not admit to wrongdoing or any illegal activity.
